On the issue of the potential continuation of EPO appeal proceedings by an intervener the questions for referral on which we already reported here:
- After withdrawal of all appeals, may the proceedings be continued with a third party who intervened during the appeal proceedings?
- In particular, may the third party acquire an appellant status corresponding to the status of a person entitled to appeal within the meaning of Article 107, first sentence, EPC?
have been accepted by the Enlarged Board of Appeal and are now pending as “G2/24” (cf. here).
Written statements in this respect in accordance with Article 10 of the Rules of Procedure of the Enlarged Board of Appeal may be submitted until April 17, 2025.
