The article sheds light on preliminary injunction proceedings before the local division of the Unified Patent Court (UPC) in Munich between the applicant Tiroler Rohre (TRM) and the defendants SSAB Swedish Steel GmbH and SSAB Europe Oy concerning pile shoes for anchoring structures in the ground.
The case illustrates the challenges faced by small and medium-sized enterprises (SMEs) in UPC proceedings, particularly with regard to cost sensitivity and limited resources. The Munich Local Division, known for its heavy workload, took several months to decide on the applicant’s request to withdraw its request for preliminary injunction, which request to withdraw was filed after the Local Division expressed doubts about the validity of the TRM patent at the oral hearing. The Local Division granted the withdrawal of the request for a preliminary injunction, but ordered the applicant to bear the costs of the proceedings and of the protective letter filed by the defendants.
